TERMS AND CONDITIONS OF SALE (T&CS)

www.labeliris.be – Label Iris (hereinafter “the Seller”)


SECTION 1 - SELLER’S CONTACT DETAILS

The website www.labeliris.be is operated by Label Iris (hereinafter “the Seller”).

SECTION 2 - DEFINITIONS

ARTICLE(S): goods that can be purchased via the Seller’s website.

BUYER / CLIENT: any natural person (Consumer) or legal entity purchasing an Article.

CONSUMER: any natural person acting for non-professional purposes.

FORCE MAJEURE: unforeseeable event beyond the Seller’s control (e.g.: war, strike, fire, pandemic, supplier stock shortage, logistical blockage, etc.) making it impossible to perform the contract.

INTELLECTUAL PROPERTY RIGHTS: rights relating to the Articles, the website, and their content (trademarks, logos, designs, photos, texts, etc.).

PARTIES: the Client and the Seller.


SECTION 3 - PURPOSE

These T&Cs govern all online sales made on the website www.labeliris.be.
Any order implies full and unconditional acceptance of these T&Cs by the Client.


SECTION 4 - PRODUCTS

The Articles offered (clothing and accessories) are described and presented with the greatest possible accuracy.
Photographs are non-contractual.
In case of unavailability, the Seller will inform the Client, who may choose either a refund or another Article.


SECTION 5 - PRICES

Prices are indicated in euros (€), all taxes included (VAT), unless otherwise stated.
Delivery costs are added to the price of the Articles and are specified before the order is confirmed.
Discounts and promotions are valid only during the period indicated.


SECTION 6 - ORDERS AND CONFIRMATION

To place an order, the Client must follow the online process: add to cart, enter billing and shipping details, choose payment method, final confirmation.
Placing an order implies acceptance of these T&Cs.
The Seller shall not be held responsible for errors made by the Client (address, details, etc.).


SECTION 7 - PAYMENT

Payment is due immediately upon ordering.
Accepted methods: Visa, Mastercard, Maestro, Bancontact, PayPal (and others indicated on the website).
If the Client’s bank refuses payment, the order will be cancelled.
Articles remain the property of the Seller until full payment has been received.


SECTION 8 - DELIVERY

All orders are processed within 3-5 business days. Orders are not shipped or delivered on weekends or holidays.
If we are experiencing a high volume of orders, shipments may be delayed by a few days. Please allow additional days in transit for delivery.
If there will be a significant delay in shipment of your order, we will contact you via email or telephone.

CUSTOMS, DUTIES AND TAXES
Label Iris is not responsible for any customs and taxes applied to your order. All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).

DAMAGES
Label Iris is not liable for any products damaged or lost during shipping. If you received your order damaged, please contact the shipment carrier to file a claim. Please save all packaging materials and damaged goods before filing a claim.

SHIPPING COSTS
Shipping costs will be calculated at checkout.
You will receive a shipment confirmation email once your order has shipped containing your tracking number(s). The tracking number will be active within 24 hours.
Delivery delays can occasionally occur.


SECTION 9 - RIGHT OF WITHDRAWAL (CONSUMERS)

We have a 14-day return policy, which means you have 14 days after receiving your item to request a return.

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

DAMAGES AND ISSUES
Please inspect your order upon reception and contact us immediately if the item is defective, damaged, or if you receive the wrong item, so that we can evaluate the issue and make it right.

EXCEPTIONS / NON-RETURNABLE ITEMS
Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalized items), underwear, and personal care goods (such as beauty products). We also do not accept returns for hazardous materials, flammable liquids, or gases.
Unfortunately, we cannot accept returns on sale items or gift cards.

EXCHANGES
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

EUROPEAN UNION 14-DAY COOLING OFF PERIOD
Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without justification.

REFUNDS
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days.


SECTION 10 - LEGAL WARRANTIES

The Consumer benefits from a 2-year legal warranty from the date of delivery for any lack of conformity.
The warranty is limited to the expected lifespan of the Article if shorter than 2 years.
Any defect must be reported within a maximum of 2 months after discovery.


SECTION 11 - LIABILITY

The Seller shall not be held liable for misuse of the Articles by the Client or a third party.
The Seller does not cover indirect damages (loss of income, non-material damage, etc.).
In case of force majeure, performance of the contract may be suspended or cancelled without compensation.


SECTION 12 - INTELLECTUAL PROPERTY

All elements on the website www.labeliris.be (texts, images, logos, designs, trademarks, etc.) remain the exclusive property of the Seller.
Any reproduction or use without authorization is prohibited.


SECTION 13 - PERSONAL DATA

Collected data (name, address, email, phone, etc.) are necessary for managing orders and deliveries.
They may be transmitted to third-party providers (shipping, invoicing, hosting).
They are stored as long as required by law (max. 7 years after the end of the contract).
The Client has rights (access, rectification, deletion, opposition, portability) by writing to hello@labeliris.be.
The Client may also file a complaint with the Data Protection Authority (APD, rue de la Presse 35, 1000 Brussels, contact@apd-gba.be).


SECTION 14 - NOTIFICATIONS

All communication between the Client and the Seller takes place via email:

  • Client: email address provided when placing the order.


SECTION 15 - AMENDMENTS TO THE T&CS

The Seller reserves the right to amend these T&Cs at any time. For ongoing orders, the applicable T&Cs are those in effect at the time of the order.


SECTION 16 - GOVERNING LAW AND DISPUTES

These T&Cs are governed by Belgian law, excluding the Vienna Convention of 1980.
In case of dispute with a Consumer, the competent court is that of the Consumer’s domicile.
For other disputes, the courts of Nivelles have sole jurisdiction.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website.
